Introduction

Welcome to Imgto3D.ai! These Terms of Service (“Terms”) govern your access to and use of the website located at https://imgto3d.ai and all related services (collectively, the “Services”). By accessing or using the Services you acknowledge that you have read, understood, and agree to be bound by these Terms.

Eligibility and Commercial Use

• Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Services.
• Commercial Use: Free-tier accounts may generate and download 3D models for personal or internal business prototyping. Redistribution, resale, or incorporation into commercial products or services offered to third parties requires a Pro subscription or separate written agreement.

Use of the Services

Imgto3D.ai provides an AI-powered 3D-model generator that converts 2D images into 3D models. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without liability.

User Conduct

You agree to use the Services only for lawful purposes. You must not upload or generate content that:

• violates any applicable law or regulation;
• infringes any third-party copyright, trademark, or other intellectual-property right;
• is defamatory, obscene, hateful, or otherwise objectionable;
• depicts minors in a sexual manner or promotes violence or discrimination;
• contains viruses, malware, or any other harmful code.

We may—but have no obligation to—remove or disable access to any content that violates these Terms.

Intellectual Property

Your Content: You retain all ownership rights in the images you upload. You grant Imgto3D.ai a non-exclusive, non-transferable, worldwide, royalty-free license solely for the duration and purpose necessary to convert your image into 3D model and deliver it to you. This license does not include the right to retain, store, or use your image for training, marketing, or any other purpose.

Our Technology: The Services, including the underlying AI technology and software, are owned or licensed by Imgto3D.ai and are protected by copyright, trademark, and other intellectual-property laws.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, IMGTO3D.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IMGTO3D.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

Refund Policy

Our service is built on a “try-before-you-buy” model. We provide a free version that gives you ample opportunity to test our basic model's functionalities and assess the output quality before committing to a purchase. We encourage all users to test this free version thoroughly. Therefore, once a purchase is made, it is considered that you are satisfied with our service and quality. We only offer discretionary refunds in exceptional cases, as outlined below:

1. Refund Eligibility

Application Window: You may submit a refund request within 5 days of your original purchase date.

Eligibility & Evidence Requirement: To be eligible for a discretionary refund, you must meet ALL of the following conditions:

You must provide a detailed reason and evidence demonstrating that even our Ultra models failed to generate a usable model. This evidence must include:

• The original 2D input image
• The resulting 3D model (or clear screenshot) from the Ultra model.

2. Refund Process and Timeline

Review and Response: Once you submit your request (with all required evidence), our team will review your case within 3-5 business days.

• Partial Refunds: Credits that have already been used are non-refundable. If your request is approved, we will issue a partial refund proportional to the amount of your unused credits.
• Denial of Refund: We reserve the right to deny the refund request if a substantial portion (e.g., over 80%) of the credits have been used, as this indicates significant use and approval of the service.

Refund Method: If approved, refunds will be processed to the original payment method.

Crediting Time: Please allow up to 2-3 business days for the funds to be credited back to your account after approval.

3. How to Request a Refund

Please submit your refund request by sending an email to [email protected]. Your email must include:

• Your registered account email.
• Order details or a screenshot of your payment.
• All required evidence as listed in Section 1 (original image, Pro result, and Ultra result).
• A detailed explanation for the refund request.

4. Technical Issues

If you are unable to use our service or your credits are incorrectly deducted due to a verified technical failure on our platform, please contact us immediately. A verified technical issue does not automatically constitute grounds for a monetary refund.

• To help us verify the issue, your report must include: your account email, a full-screen screenshot of the issue (including any error messages), your browser and operating system, and the specific date/time.
• If our team verifies the technical failure, we will compensate you for the lost credits.

5. Subscription Cancellation

You may cancel your subscription at any time. After cancellation, your subscription will terminate at the end of the current billing cycle, and you will not be charged for the next cycle. You can continue to use your remaining services until the cycle ends.

Refund FAQ

Q: What should I do if I am not satisfied with the AI-generated 3D model?

A: The AI generation process has a degree of randomness, and achieving the best result can sometimes require a few attempts. We highly recommend you try the following methods to optimize and improve your outcomes:

• Generate Multiple Times: Try generating from the same image several times. The AI may produce a better result with different details.
• Optimize the Input Image: Ensure your image is not too flat and already has some 3D effect and perspective. Our '3d style transformer' editor can help you achieve this. Images with good perspective tend to produce 3D models with cleaner topology and higher quality.
• Use the Ultra Model: If you are a paid user, try our Ultra model. It is trained on higher-quality data and is specifically designed to generate high-fidelity, detailed models, often outperforming the standard model.

Termination and Data Deletion

We may terminate or suspend your access to the Services at any time, with or without cause. Upon termination, we will delete any uploaded images and generated models within 30 days, except as required by law.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last Updated” date and, where feasible, notified via prominent notice on the website or via the email address associated with your account at least 15 days before the change takes effect. Continued use of the Services after any such changes constitutes acceptance of the revised Terms.
